Casa Picasso Cabo – Website & Booking Terms and Conditions
Last updated: November 27, 2025 These Website & Booking Terms and Conditions (“Terms”) tell you the rules for accessing and using www.CasaPicassoCabo.com. (the “Website”) and for making booking enquiries or reservations for the property known as Casa Picasso Cabo (the “Property”). In these Terms: • “Casa Picasso Cabo”, “we”, “us”, “our” means the owner and/or authorized manager of the Property and the operator of this Website. • “you”, “your” means any person visiting the Website or making an enquiry or booking in relation to the Property. • “Guest” means a person who books or stays at the Property. • “Visitor” means a person who only uses the Website. By using our Website and/or proceeding with a booking, you agree to be bound by these Terms. If you do not agree, you must not use our Website or proceed with a booking.
1. Who We Are and How to Contact Us
The Website CasaPicassoCabo.com is operated and managed by the owner and/or authorized manager of Casa Picasso Cabo, a private vacation rental property located in Cabo San Lucas, Mexico. To contact us, please use the contact details or contact form shown on the Website (for example, hey@budly.com).

We may update and change our Website from time to time to reflect changes to the Property, our services, our guests’ needs or our business priorities. We do not guarantee that our Website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Website for business or operational reasons.

8. Bookings & Our Role
All bookings or rental agreements for Casa Picasso Cabo are made directly between you (the Guest) and the owner/authorized manager of the Property.
- The Website is an information and contact platform only.
- We do not act as an online travel agency, broker, platform operator or as a party to any contract between you and any third party.
- Any booking, payment arrangement, deposit, cancellation policy, house rules and other terms will be set out in your Booking Terms, booking confirmation or rental agreement for your stay.
Before paying any deposits or confirming a reservation, you should:
- Carefully read all Booking Terms and conditions provided, and
- Confirm you understand cancellation rules, deposit requirements, security deposits, check-in/check-out times, occupancy limits and additional charges (e.g. cleaning, damage, extra guests).
If you proceed with a booking, you agree to comply with all House Rules and Booking Terms provided.
9. Guest Responsibilities
By making an enquiry or booking Casa Picasso Cabo, you confirm that:
- You are at least the minimum legal age to enter into a binding contract in your jurisdiction and in Mexico.
- All information you provide is true, accurate and not misleading.
- You will not use the Property for any unlawful, unsafe, or prohibited purpose.
- You will comply with:
- The maximum occupancy limits,
- House Rules (including noise, smoking, pets, visitors, and use of facilities), and
- Any condominium/community rules that may apply.
- You will treat the Property, its contents, neighbours, and community with respect and care.
- You accept financial responsibility for any damage or excessive cleaning caused by you or your party, in accordance with the Booking Terms.
10. Owner Compliance, Licensing & Legal Responsibility
We aim to provide a safe and transparent environment for guests.
Because local requirements can vary (national, state, municipal and even neighbourhood rules), the owner/manager is responsible for complying with all applicable legal, licensing and tax requirements in the relevant jurisdiction.
By offering Casa Picasso Cabo for rental, we confirm that we will use our best efforts to ensure that:
- The Property is legally permitted to be rented as a vacation/short-term rental where required.
- Any required licences, registrations or permits are obtained and kept up to date (for example: tourist-rental licence, tax registration number, or local municipal approvals).
- Applicable safety, fire and building standards are met, including any required equipment or signage.
- Any CCTV/security cameras installed in or around the Property are disclosed to guests in advance and appropriately signed on site.
- We comply with all relevant tax obligations relating to rental income.
We do not make any representation that the Website complies with the laws of any country from which you may be accessing it. You are responsible for ensuring your own compliance with all laws applicable to you as a Guest or Visitor.
11. Security, Viruses & Account Details (If Applicable)
We do not guarantee that our Website will be secure or free from bugs or viruses.
You are responsible for:
- Configuring your device, systems and internet connection in order to access the Website, and
- Using your own virus protection software.
You must not:
- Misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.

- You must not post anything defamatory, hateful, discriminatory, obscene, or otherwise inappropriate.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display and reproduce that content in connection with the Website and promotion of the Property (for example: displaying your review on the Website).
If you consider any content or images on our Website to be offensive, discriminatory, defamatory, infringing or otherwise inappropriate, please notify us with details of:

- To the maximum extent permitted by law, we are not liable for:
- loss of profit,

To the maximum extent permitted by law, we:

- Will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

In particular, we will not be liable for:
- loss of profits, sales, business, or revenue;

14. Disputes Between Guests and Owner/Manager
The Website is a place where prospective Guests can view information about Casa Picasso Cabo and contact the owner/manager.
Any booking contract, dispute, claim or issue arising from:
- The condition of the Property,
- The conduct of Guests, or
- Payments, cancellations, refunds or deposits,
is between you and the owner/manager directly.
You agree that:
- Any issues or disputes in relation to a booking or stay will be brought directly against the owner/manager and not against the Website as a platform or host.
- Nothing in these Terms prevents us from pursuing any Guest for breach of these Terms or House Rules.
15. Data Protection & Privacy
We will collect and process personal information about you in accordance with our Privacy Policy, which forms part of these Terms.
By using the Website or providing your personal data (for example when making an enquiry or booking), you consent to us handling your information in accordance with that Privacy Policy.
16. Termination or Suspension of Access
We may, at our discretion, suspend or terminate your access to the Website and/or refuse any booking or future booking if:
- You seriously or repeatedly breach these Terms or any Booking Terms;
- You provide false or misleading information;
- We reasonably believe your behaviour is abusive, fraudulent, illegal or harmful to us, the Property, our staff, neighbours or other guests.
Where reasonable, we will notify you of suspension or termination, but we are not obliged to provide prior notice in cases of serious breach or risk.
Termination or suspension of access to the Website does not affect any existing legal rights or obligations that have already arisen.
17. Force Majeure
We will not be in breach of these Terms or any Booking Terms, nor liable for any delay in performing or failure to perform any of our obligations, if such delay or failure results from events, circumstances or causes beyond our reasonable control (including but not limited to natural disasters, extreme weather, war, riots, strikes, pandemics, government restrictions, power outages or major technical failures).
Where such a situation arises, our obligations will be suspended for the duration of the event, and we will work with you in good faith to find a reasonable solution in line with any applicable Booking Terms.
18. Governing Law and Jurisdiction
These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of the State of Baja California Sur, Mexico.
You and we agree that:
- The courts of Cabo San Lucas, Baja California Sur (or such other courts as required by mandatory local law) will have exclusive jurisdiction, except where mandatory consumer protection rules in your country of residence provide otherwise.

Notices will be deemed received when sent to the latest email address you have provided to us, or, in the case of notices from you to us, when we confirm receipt.
